1. Who we are
Elefair (the "Platform") is operated by Elefair International Inc, a company organized under the laws of the State of New York, United States ("Elefair", "we", "us"). Elefair is an online marketplace that connects independent sellers located in the United States and worldwide ("Sellers") with buyers ("Buyers"). These Terms of Service ("Terms") govern your access to and use of the Platform, including the website, mobile apps, browser extensions and related services.
2. Acceptance
By creating an account, placing an order, listing a product or otherwise using the Platform you agree to these Terms, our Privacy Policy and, where applicable, the Global Vendor Agreement, Buyer Protection & Chargeback Policy and all policies linked from the Help Center. If you do not agree, do not use the Platform. You must be at least 18 years old and able to form a binding contract.
3. Marketplace role
Elefair provides the venue, checkout, Buyer Protection and dispute resolution. Unless an item is expressly marked as "Sold by Elefair" or "Fulfilled by Elefair", the Seller is the merchant of record for the item, is responsible for the listing's accuracy, legality, quality, safety and shipment, and the contract of sale is between you and the Seller. Elefair collects payment on the Seller's behalf and holds funds until delivery under Buyer Protection.
4. Accounts
You are responsible for your account credentials and all activity under your account. Provide accurate information and keep it updated. We may suspend or terminate accounts that breach these Terms, our policies or applicable law, or that present fraud or security risk.
5. Purchases, pricing and payment
Prices are shown in US dollars and include the Seller's price and Elefair's service; applicable sales tax, shipping and, for international orders, customs duties (see the Customs, Duties & Import Taxes Policy) are shown or explained at checkout. Payments are processed by Stripe; Elefair never stores full card numbers. Orders may be cancelled per the Order Cancellation Policy.
6. Shipping, returns and protection
Shipping times, returns and refunds are governed by the Global Shipping & Delivery Policy, the International Return, Refund & Exchange Policy and the Global Buyer Protection & Chargeback Policy.
7. Prohibited conduct
You may not: list or buy items on the Prohibited & Restricted Items list; infringe intellectual property (see our DMCA Policy); manipulate reviews, rankings or ads; circumvent fees or complete marketplace transactions off-platform; scrape, reverse-engineer or overload the Platform; harass users or staff; or use the Platform for unlawful purposes.
8. Content and licence
You retain ownership of content you post (listings, reviews, messages) and grant Elefair a worldwide, royalty-free licence to host, display, reproduce, adapt and distribute it to operate and promote the Platform, including on partner channels such as eBay, Walmart and Google. Elefair may use AI tools to rewrite listing copy for clarity and compliance.
9. Intellectual property
The Elefair name, logo, software and design are owned by Elefair International Inc. Nothing in these Terms grants you rights in them except as needed to use the Platform.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, Elefair DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND MAKES NO WARRANTY ABOUT ITEMS SOLD BY SELLERS. 11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Elefair International Inc AND ITS OFFICERS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO Elefair FOR THE TRANSACTION GIVING RISE TO THE CLAIM IN THE PRECEDING 12 MONTHS OR (B) USD 100. Some jurisdictions do not allow these limitations; in that case they apply to the maximum extent permitted.
12. Indemnity
You will indemnify and hold harmless Elefair International Inc from claims, losses and expenses (including reasonable attorneys' fees) arising from your content, your use of the Platform, your breach of these Terms or your violation of law or third-party rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of New York and applicable US federal law, without regard to conflict-of-law rules. Any dispute that cannot be resolved through Elefair Support within 30 days shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring individual claims in small-claims court or seek injunctive relief for IP infringement in the state or federal courts of New York County, New York. Class actions and class arbitrations are waived. Users outside the US consent to this forum; nothing limits mandatory consumer rights that apply in your country.
14. Changes
We may update these Terms. Material changes are announced on the Platform or by email at least 14 days before they take effect; continued use after that date is acceptance.
